House Republicans filed their first brief in the Windsor case today, blasting the Obama administration for abdicating its responsibility to defend DOMA in court. Their basic argument seems to be that heterosexual marriages can produce unintended and unplanned offspring, which same-sex marriages cannot do. So they're seriously arguing that random babies make a marriage?
Prop 8 supporters also filed their first briefs, and their argument seems to be that it's basically none of the Supreme Court's business. "Our Constitution does not mandate the traditional gendered definition of marriage, but neither does our Constitution condemn it. This Court, accordingly, should allow the public debate regarding marriage to continue through the democratic process, both in California and throughout the Nation."
And President Obama feels that marriage equality is a state's rights issue and not one for the federal government. Which has some people outraged, but isn't that really the basis for our challenges to DOMA?
